Nirvana Terms of Service

Welcome to Nirvana ebook (operated by Sarthak Enterprises). ("Nirvana", "we", "our", or "us"). These Terms of Service ("Terms") govern your access and use of our website, web app, mobile app, and all related services (collectively, the "Platform").

By creating an account or accessing Nirvana, you agree to these Terms. If you do not agree, please do not use our Platform.

1. Who We Are

Nirvana is an Indian digital eBook library and distribution platform. We partner with publishers to make educational content accessible and eco-friendly for students, teachers, and lifelong learners.

2. User Eligibility

To use Nirvana, you must:

• Be at least 5 years old (or meet your jurisdiction's minimum age).
• Provide accurate, current, and complete information during registration.
• Use the Platform only for lawful purposes.

If you are accessing Nirvana on behalf of an organization (e.g., a publishing house), you represent that you are authorized to accept these Terms on its behalf.

3. Account Registration and Security

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Immediately notifying Nirvana of any unauthorized use or security breach.

We recommend using strong passwords and enabling multi-factor authentication (if available).

4. Purchasing and Accessing eBooks

• eBooks available on Nirvana are licensed, not sold.
• Once purchased, the eBook is added to your readable personal digital library.
• Each purchase is linked to your Nirvana account and cannot be downloaded, shared, transferred, or resold.
• Refunds: As per our Return Policy, eBooks are non-returnable and non-refundable once purchased.

5. Gifting, Wishlist & Cart

• Users may add titles to a wishlist, store books in a cart, or gift eBooks to another registered Nirvana account.
• The recipient will receive access through their account upon acceptance.
• All gifted eBooks are subject to the same license and usage terms as standard purchases.

6. License and Usage Rights

When you purchase an eBook, you receive a non-exclusive, non-transferable, limited license to:

• Access and read the book through Nirvana's proprietary 3D Flipbook web interface.
• Use it solely for personal, educational, or non-commercial purposes.

You may not:

• Download, copy, or distribute the eBook file (PDF or any format)
• Share your login or screen-record reading sessions.
• Circumvent, disable, or tamper with DRM or security features.

Violation of these terms may result in account suspension or legal action.

7. Publisher Terms

For publishers partnering with Nirvana:

• You retain full ownership of your intellectual property (copyright).
• By uploading or licensing your content, you grant Nirvana a non-exclusive right to distribute, display, and sell your eBooks through our Platform.
• Revenue is split as follows: 70% to the publisher or rights holder, and 30% retained by Nirvana as a platform fee.
• Publishers agree not to upload infringing or unlawful content.

8. Payments and Pricing

• All payments are processed securely via trusted third-party gateways (e.g., Razorpay, Stripe, Paytm).
• Prices are displayed in INR and inclusive of applicable taxes.
• Nirvana reserves the right to modify pricing, discount policies, or payment methods at any time.

9. Intellectual Property

All rights to the Nirvana Platform, including UI design, logos, software, and proprietary 3D Flipbook technology, are owned by Nirvana Digital Publishing Pvt. Ltd.

You may not copy, modify, reverse engineer, or use our brand assets without written consent.

10. Prohibited Activities

You agree not to:

• Misuse or disrupt the Platform.
• Upload or share illegal, obscene, or infringing materials.
• Attempt to hack, phish, or gain unauthorized access to systems or accounts.
• Engage in activities that violate applicable Indian laws or global copyright regulations.

11. Content Accuracy and Availability

While we strive for accuracy, Nirvana does not guarantee that all content, descriptions, or pricing are error-free.

We may update, modify, or remove titles or features without prior notice.

12. Termination of Account

Nirvana may suspend or terminate your account if:

• You violate these Terms or applicable laws.
• You engage in fraudulent or abusive activities.

13. Limitation of Liability

To the maximum extent permitted by law, Nirvana shall not be liable for:

• Indirect or consequential losses.
• Data loss, unauthorized access, or service interruption.
• Damages resulting from third-party acts beyond our control.

Your sole remedy is to discontinue use of the Platform

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.
Any disputes will be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

15. Policy Changes

We may revise these Terms periodically.
